Marshall Sparkles – Terms & Conditions (Print‑to‑Order and Affiliate Items only)

1. Made‑to‑Order Production

Certain products offered by Marshall Sparkles are created using a print‑to‑order or factory‑direct process. This means:

• The item is paid for in full at the time of purchase.

• Your order is then sent directly to our production partners for custom printing, manufacturing, or fulfilment.

• Each item is produced specifically for you based on your chosen design, size, colour, or customisation.

2. Non‑Refundable & Non‑Returnable Items

Because these items are custom‑made to your order, they cannot be returned, exchanged, or refunded.

This includes (but is not limited to):

• Print‑to‑order merchandise

• Items shipped directly from the factory

• Products customised with your selected design or specifications

Once production has begun, the order cannot be cancelled.

3. Tracking Information

Once your item has been printed and dispatched, a tracking number will be added to your order.

Tracking must be checked using the 17Track app, as factory‑direct shipments do not update correctly through the Shop app.

Customers are responsible for using the correct tracking platform to follow their delivery.

4. Chinese New Year Production Delays

Our production partners close for Chinese New Year each year, typically from 1st February to 1st March.

During this period:

• Printing and fulfilment times may be significantly delayed.

• Orders placed before or during this time are still paid for, queued, and non‑refundable, even while the factory is closed.

• Tracking numbers will be provided once production resumes and your item has been printed.

5. Exceptions for Faulty or Incorrect Items

If your item arrives:

• damaged,

• defective, or

• significantly different from what you ordered,

please contact us within 7 days of delivery with clear photos and your order number.

We will work with our production partner to resolve the issue, which may include a replacement or alternative solution.

Please note: minor variations in colour, print placement, or sizing may occur due to the nature of print‑to‑order manufacturing and are not considered defects.

6. Shipping & Fulfilment

Print‑to‑order and factory‑direct items may ship separately from other items in your order.

Production and delivery times can vary depending on the item and destination.

7. Acceptance of These Terms

By placing an order for a print‑to‑order or factory‑direct item, you acknowledge and agree to these Terms & Conditions, including the non‑refundable nature of the purchase and the tracking and delay policies outlined above.

Marshall Sparkles Affiliate Terms & Conditions 

1. Eligibility

To join the Marshall Sparkles Affiliate Programme, you must be over 18, have an active social media presence, and agree to all programme rules. Affiliates must promote Marshall Sparkles in an honest, respectful, and professional manner.

2. Affiliate Codes

Each affiliate receives a unique discount code to share with customers.

Affiliates may use their own code for a personal £5 discount, however:

• You will not earn commission on any order where you used your own code.
• Commission is only paid on genuine customer referrals.
• Partners, household members, and close friends must not use the code to generate commission for the affiliate.

3. Commission & Payments

Affiliates earn commission on qualifying sales made using their code.
Commission is paid monthly and can be received as cash or store credit.
All earnings are classed as self‑employment income, and it is the affiliate’s responsibility to declare this to HMRC.

Switching From Free Items to Cash Payments

If an affiliate previously agreed to receive free items instead of monetary commission, but later chooses to switch to receiving money, the value of all free items already received will be deducted from future commission payments.

4. Misuse of Codes

The following is considered misuse:

• Using your code to generate commission for yourself
• Encouraging friends/family to use your code to earn commission
• Creating fake orders or false referrals

Misuse may result in:

• Removal from the programme
• Deactivation of your code
• Loss of unpaid commission

5. Promotion Standards

Affiliates must:

• Represent the brand professionally
• Use accurate information
• Avoid drama, negativity, or behaviour that harms the brand
• Follow all platform rules (TikTok, Facebook, Instagram, etc.)

6. Content Requirements

Any content created for Marshall Sparkles must:

• Be original
• Be respectful and appropriate
• Not include copyrighted music or images without permission

Marshall Sparkles may share or repost affiliate content with credit.

7. Prohibited Behaviour

The following is not allowed:

• Misleading claims
• Harassment or bullying
• Sharing confidential information
• Any behaviour that damages the reputation of Marshall Sparkles

Affiliates are allowed to promote other companies, including other craft or hobby brands.
They simply must not present themselves as representing Marshall Sparkles while promoting another brand.

8. Exclusivity

Affiliates may promote other companies, but you may not work with or promote another diamond painting company using Marshall Sparkles designs, branding, or content.

If you leave the programme, you may not use Marshall Sparkles designs, branding, or content with another company.

9. Removal From the Programme

Marshall Sparkles reserves the right to remove any affiliate at any time for:

• Policy breaches
• Inactivity
• Misconduct
• Brand damage

Removal may include deactivation of your code and removal of unpaid commission.

10. Programme Changes

Marshall Sparkles may update these Terms & Conditions at any time. Continued participation means you accept the updated terms.

Unauthorised Use of Free Items

Affiliates may not use free items, gifted items, or discounted items provided by Marshall Sparkles to develop, design, or produce products for their own business or for any competing business.

If an affiliate uses free items for personal business development, the full retail value of those items will be deducted from any outstanding or future commission payments.

11. Use of Affiliate Earnings

Affiliate commission must not be used to fund the creation, launch, or operation of a competing business.

If affiliate earnings are used to support a competing business, Marshall Sparkles reserves the right to:

• Deduct earnings already paid
• Remove the affiliate from the programme
• Revoke access to all affiliate benefits

12. Brand Imitation & Name Misuse

Affiliates must not use the Marshall Sparkles name, branding, or any confusingly similar variation to create or promote their own business.

This includes, but is not limited to:

• Using “Sparkles” in a business name
• Creating a brand that imitates or resembles Marshall Sparkles
• Using Marshall Sparkles designs, themes, or concepts to build a competing brand

Any attempt to create a business that could mislead customers into thinking it is connected to Marshall Sparkles will result in immediate removal from the programme and potential legal action.

13. Competing Business Clause

Affiliates may promote other companies, but they may not:

• Use Marshall Sparkles resources to build a competing business
• Use Marshall Sparkles designs, products, or branding for their own business
• Operate a diamond painting business that imitates or copies Marshall Sparkles’ identity
